Although the term litigation is generally used to refer to the process of establishing, contesting and enforcing legal rights in the a court of law, the term litigation lawyer is usually reserved for lawyers who specialise in resolving commercial disputes.

The role of a litigation lawyer is to focus on achieving the commercial objectives of their clients. Since their main role is to work with lawsuits, litigation lawyers are primarily concerned with taking a lawsuit to court and trying to win a case. However, some cases will be settled out of court.
